News Summary:

The new regulation regarding Safety Certification for Electrical Products was issued in Argentina on October 21st, 2015. Resolution 508/2015 from the Argentine Ministry of Commerce supersedes Resolution 92/98. The new Resolution 508/2015 will be enforced on November 23rd, 2015.

The product scope and exemptions of Resolution 508/2015 are the same as Resolution 92/98. The main changes affecting the certification process are:

  • S Mark certificates must be issued exclusively to local entities with an address in Argentina. Foreign applicants cannot be certificate holders.
  • Certification processes will be based on complete type testing (not reduced testing) in Argentina. Validation of existing certifications is not allowed (i.e. based on UL or CB).
  • S Mark certificates must be issued in compliance with the safety requirements established by the corresponding local IRAM standard. In case no IRAM standard exists, or not enforced, the requirements will be those established by the applicable IEC Standard (This includes IEC 60950-1, IEC 60065, IEC 60335-1, IEC 60601 and others).

Under Resolution 508/2015 the local importers will have to apply to be certificate holders and surveillance controls will be strengthened with more samples to be tested at each periodical control.

IMPACT TO EXISTING S MARK CERTIFICATE HOLDERS:

  • For customers that have existing S mark certificates issued to their local importers before November 23rd, 2015, there is no impact.
  • For customers that have existing S mark certificates issued; however have not yet extended a certificate to their local importer, your local importer will need to obtain their own S mark certificate. In this case, full testing in Argentina will need to take place prior to issuance of the certificate.

NOTE: If you currently do not have an importer; you are not able to commercialize the product in Argentina. You will need to determine if you want to maintain your current S Mark certificate and continue to pay the annual maintenance fee.

The Ecuador regulator, ARCOTEL, has issued that devices with 2G/3G function must operate in at least the 850MHz and 1900MHz, and 4G/LTE function must operate in the LTE bands 2 and 4. If with these functions but do not operate in these bands, Type Approval cannot be obtained in Ecuador.
